Rushed Confirmation of Judge Amy Coney Barrett Damages Integrity of SCOTUS & McConnell-Led Senate

Tonight, under Majority Leader Mitch McConnell’s direction, Senate Republicans did profound damage to the Senate and the Supreme Court of the United States. They subverted the serious and deliberative constitutional obligation that we (and many others) called on them to uphold just 38 days ago. Instead, they rushed through Committee hearings and made a mockery of advice-and-consent by ramming Judge Amy Coney Barrett’s nomination through to a lifetime appointment only eight days before Americans finish voting and after more than 60 million Americans have already voted. In so doing, Senate Republicans excused her incomplete answers to basic questions—demurring on whether “climate change is happening” (it is) and whether voter intimidation violates federal law (it does). They smothered Justice Ginsburg’s “most fervent wish” that her replacement be considered after the election. And they did so at the expense of millions of Americans suffering from the coronavirus pandemic who desperately needed the Senate to negotiate and pass COVID relief legislation.

Trump Continues Attempts to Confuse Voters & Undermine Faith in Elections on Debate Stage

President Trump further attempted to confuse voters and undermine the integrity of our elections tonight. Instead of encouraging people to participate in the political process, he continued to spread lies to try to delegitimize the election results. Voters should know the truth: voting by mail is a secure, tried, and tested process with checks, balances, and safeguards.

Common Cause Files Reply Brief Seeking Summary Judgment Against Trump’s Directive to Exclude Undocumented Immigrants in Census Apportionment Calculations

On Wednesday, Common Cause filed its reply brief in support of its motion for summary judgment in its challenge to President Trump’s memorandum requiring the exclusion of undocumented immigrants from the congressional apportionment base following the 2020 Census. The brief, filed in the U.S. District Court for the District of Columbia in Common Cause v. Trump, also urges the court to expedite proceedings so that a final judgment and appeal to the U.S. Supreme Court can be completed before January  2021, when the President is scheduled to send apportionment numbers to Congress.

Trump Call to Supporters to Vote Twice is a Felony for Inciting a Felony

Americans expect and deserve more from their President than statements urging his supporters to commit a felony by voting for him twice in the coming election. President Trump’s repeated requests to his followers to commit felonies are felony crimes themselves because he is inciting the commission of those crimes. And if the last several years have taught us anything, it is that some Trump followers will do virtually anything Trump recommends including taking unproven, unapproved, and potentially dangerous medications he has recommended for COVID-19.

Common Cause Files for Expedited Review & Summary Judgment in Challenge to Trump’s Directive to Omit Undocumented Immigrants in Census Apportionment Calculations

Tonight, Common Cause filed motions for expedited review and summary judgment in its challenge to President Trump’s memorandum requiring the exclusion of undocumented people from being counted in the congressional apportionment base following the 2020 census.  Should the court find summary judgment unavailable, Common Cause moved in the alternative for an expedited trial on the merits. The motions filed in the U.S. District Court for the District of Columbia in Common Cause v. Trump urge the court to expedite proceedings so that a final judgment and appeal to the U.S. Supreme Court can be completed before January  2021, when the President is scheduled to send apportionment numbers to Congress.
