“The court has now made clear what our clients have been saying all along — the winner of November’s gubernatorial election will appoint three justices to the Florida Supreme Court,” said John Mills, attorney for the Florida branch of the League of Women Voters and Common Cause who filed the lawsuit. “Governor Scott will not, and he has no part to play in these appointments.”

The lawsuit from the League of Women Voters of Florida and Common Cause Florida maintains that Scott does not have the power to make the appointments ahead of when the positions will be vacant. Instead the lawsuit argues the decision must be left to his successor.

“Given how quickly Senator Collins and Senator Murkowski called on then-Senator Franken to resign after the story came out about his sexual harassment, sexual assault, I think they’ll be under that much more scrutiny,” said Aaron Scherb with Common Cause. “There are so many unanswered questions about Professor Ford and this sexual abuse from several decades ago. We believe that needs to come out,” Scherb said.

Well, conservatives have had their sights set on these limits for a long time. According to Paul Seamus Ryan from Common Cause, two contributions-limits cases currently have certiorari petitions before the Supreme Court, one from Montana and the other from Texas. “Both jurisdictions’ limits were upheld by the circuit courts—and the plaintiffs/petitioners in both cases are asking the Supreme Court to hear their cases and declare the challenged contribution limits unconstitutional,” Ryan told me Wednesday.

We call on the anonymous author and allies within the administration to stand up for our Constitution and step outside government, make a case to the American people — whom you work for — and let the people decide how best to put a check on this administration and demand action from Congress. Congress must do its constitutional duty to investigate the serious allegations made by anonymous by holding public hearings immediately.

“It’s actually one of the biggest threats to our democracy that most people have never heard about,” said Karen Hobert Flynn, president of Common Cause.
