Nebraska Supreme Court to Hear Common Cause Voter File Lawsuit, SOS Should Not Release the Data

The Nebraska Supreme Court granted Common Cause an expedited hearing on appeal in its lawsuit trying to prevent Secretary of State Bob Evnen from releasing sensitive voter data to the federal government.

The Nebraska Supreme Court granted Common Cause an expedited hearing on appeal in its lawsuit trying to prevent Secretary of State Bob Evnen from releasing sensitive voter data to the federal government. 

The court set an expedited date of March 31 to hear the appeal. Common Cause believes the Court wants to weigh in before the Secretary releases any voter data. 

In September, Common Cause sued Secretary of State Bob Evnen to block the release of the non-public voter file. The lawsuit argues state officials—not the federal government—must control Nebraska’s election data and that releasing sensitive voter information violates both voter privacy and Nebraska law. 

“The Nebraska Supreme Court is sending a strong message – don’t release voters’ sensitive data without the Court ruling on the facts in this case,” said Gavin Geis, Common Cause Nebraska Executive Director. “The Secretary of State needs to listen. We have always believed in the merits of this case and the importance of protecting Nebraskans. We are looking forward to our day in front of the court.”
