","featured_image":4527,"article_type":1103,"authors":null,"related_issues":[103,2066],"related_work":false,"location":null},"sidebar":{"helper_enable_sidebar":false,"helper_media_contact":{"heading":"Media Contact","manually_enter_person":false,"person":null,"name":"","role":"","phone":"","email":""},"helper_links_downloads":{"heading":"Links & Downloads","links":null}},"page_layout":[{"acf_fc_layout":"layout_image_and_text","_acfe_flexible_toggle":null,"component_image_and_text":{"manually_curate":true,"image_side":"left","row_color":"blue","work":null,"kicker_text":"","title":"","summary":"Maps drawn by politicians are more than three times more likely to require court intervention than those drawn by independent citizen commissions, according to<\/span>\u00a0<\/span>data<\/span>\u00a0analysis<\/span>\u00a0from Common Cause and the Campaign Legal Center.<\/span>\u00a0<\/span>\r\n\r\nOver 38 percent of state and congressional district maps where politicians controlled redistricting in the 2010-cycle were either struck down by courts or drawn by courts when politicians failed to agree on maps. This includes states in which elected officials are in charge of redistricting either through the legislative process or in politician commissions. However, only 11 percent of maps drawn by independent citizen commissions with partisan balanc<\/span>e suffered a similar fate<\/span>.\u00a0<\/span>The politician totals include two maps struck down today<\/a> by a federal Michigan court<\/span>.\u00a0<\/span>\u00a0<\/span>\r\n\r\nThe significant difference shows that politicians are not drawing district lines with people in mind and are wasting taxpayer dollars on losing cases. It also provides evidence that the states that passed reforms last year to remove map-drawing powers from politicians and give it to citizens commissions were on the right track. <\/span>\u00a0<\/span>\r\n\r\n\u201cThe<\/span>\u00a0redistricting process\u00a0<\/span>always\u00a0<\/span>raises\u00a0<\/span>the question of who draws better maps,\u201d said Dan Vicuna, national redistricting manager for Common Cause. \u201cLegislators claim they do, that they know their communities best, but the fact is they are wrong. Politicians\u2019 primary interest in not\u00a0<\/span>in fairly representing\u00a0<\/span>communities, it is their own re-election and in giving their party an advantage, and that\u00a0<\/span>often violates<\/span>\u00a0the law.\u201d<\/span>\u00a0<\/span>\r\n\r\nThe maps that were struck down had all sorts of problems. In Florida, politicians violated a state constitutional prohibition against drawing state and congressional maps with an advantage for a party or candidate. Common Cause helped pass the provision, challenged the maps and prevailed in state court in 2015.<\/span>\u00a0<\/span>\r\n\r\nPoliticians were found guilty of racial gerrymandering in states like Virginia and Alabama. North Carolina is a particularly bold violator. After maps there were struck down as a racial gerrymander, map-drawers notoriously stated in public that they were drawing new maps to give Republicans a partisan advantage. Common Cause has challenged that map all the way to the U.S. Supreme Court. A decision in\u00a0<\/span>Rucho<\/span><\/i>\u00a0v. Common Cause<\/span><\/i><\/a>\u00a0is expected in June.<\/span>\u00a0<\/span>\r\n\r\nThere is an alternative to politician-drawn maps. Five states \u2013 Arizona, California, Idaho, Montana and Washington \u2013 give the power to draw maps to independent citizen commissions<\/span>\u00a0with partisan balance<\/span>. These commissions are considered \u201cindependent\u201d because no legislator or governor has any say in the approval of the maps.<\/span>\u00a0<\/span>\r\n\r\n\u201cMaps drawn by independent citizen commissions are far more likely to withstand a legal challenge because the people drawing the maps are actually motivated by fairness,\u201d Vicuna said. \u201cThey want fair representation. They want to keep communities together. They want\u00a0<\/span>citizens\u2019\u00a0<\/span>votes to count.\u201d<\/span>\u00a0<\/span>\r\n\r\nJust one map drawn by a<\/span>\u00a0balanced\u00a0<\/span>independent commission during the 2010-cylce was struck down \u2013 in Idaho, a historically one-party state with less than 2 million residents. Map-drawers there were found by a state court found to have split more counties than necessary.\u00a0<\/span>\u00a0<\/span>\r\n\r\nVicuna attributes the legal issue not to racial or partisan intentions, but a short-coming on the commission\u2019s structure. Idaho allows legislators and political party leaders\u00a0to\u00a0<\/span>directly\u00a0<\/span>appoint commissioners without the assistance of\u00a0<\/span>a nonpartis<\/span>an entity to screen candidates. Also, the limited restrictions on who can serve only prohibit individuals who have been a lobbyist in the\u00a0previous\u00a0year or those who have been elected officials or candidates in the previous\u00a0two years.\u00a0<\/span>\u00a0<\/span>\r\n\r\nMore states are moving toward citizen commissions and away from partisan map drawers\u00a0<\/span>on the belief that voters should choose their politicians, not the other way around<\/span>.\u00a0In 2018, the states of Colorado, Michigan, Missouri, Ohio and Utah passed redistricting reforms to dilute the power of politicians to draw<\/span>\u00a0districts<\/span>. Ballot measures to establish citizen commissions are taking shape in Nebraska and Oregon<\/span>\u00a0to do the same<\/span>.<\/span>\u00a0<\/span>\r\n\r\n\u201c<\/span>Courts look kindly on maps drawn by people with fairness in mind, and they strike down egregious maps drawn by politicians that protect their own power,<\/span>\u201d Vicuna said.<\/span>\u00a0\u201cIt matters who draws the lines.\u201d<\/span>\u00a0<\/span>","image":5782,"post_link":"","button_text":"","secondary_link":null}}]},"yoast_head":"\nPoliticians Lose More Gerrymandering Cases: Courts -
