Common Cause Files SCOTUS Amicus in Birthright Citizenship Case

At stake is not just the future of birthright citizenship, but the ability for federal courts to defend constitutional rights against presidential overreach.

On his first day in office, President Trump issued an executive order attempting to end the 14th Amendment’s guarantee of citizenship to anyone born in the United States. Federal courts swiftly blocked the order via nationwide injunctions, recognizing it as a blatant violation of the Constitution. The Supreme Court allowed those injunctions to remain in place and will hear arguments on May 15.

In addition to defending birthright citizenship, Common Cause’s brief focuses on the Trump administration’s dangerous attempt to weaken federal courts by taking away their power to fully stop unconstitutional actions—one of the most important tools courts use to protect people’s rights and maintain the checks and balances that safeguard our democracy.

The United States has presidents, not kings, and our constitution cannot be overruled by executive order. Just because President Trump wants to get rid of birthright citizenship, does not give him the power to do so.

If Donald Trump can change what it means to be a citizen in this country for one group of Americans, he can do it for all Americans. No one is safe if this administration is allowed to railroad their way through our laws. That’s why it is critical that the lower courts be able to stop unconstitutional acts nationwide before they do serious harm.

The 14th Amendment is one of the most fundamental promises of equality and fairness in our Constitution. Every single person born here is entitled to the same rights, protections, and opportunities, period. One president cannot and will not change what it means to be an American for us or our families.
