The Kansas law was an attempt to counter provisions of the National Voter Registration Act, which allows prospective voters to register when they do business at state motor vehicle offices.\r\n\r\nThe judge said Kobach failed to present evidence that significant numbers of non-citizens are registering and that the law \u201calso may have the inadvertent effect of eroding, instead of maintaining confidence in the electoral system.\u201d\"\"\r\n\r\nKobach vowed to appeal and asserted that the judge\u2019s decision breaks with precedents set by the U.S. Supreme Court.\r\n\r\nRobinson\u2019s ruling was no surprise; she earlier issued a preliminary injunction against enforcement of the Kansas law.\u00a0 Her rebuke of Kobach, who is running for governor and has been a high-profile adviser to the Trump administration on voting issues, was unusual however.\r\n\r\nThe judge wrote that Kobach exhibited \u201ca pattern and practice\u2026 of flaunting disclosure and discovery rules that are designed to prevent prejudice and surprise at trial. Because Kobach continued to break the rules despite her repeated warnings, \u201cthe court finds that further sanctions are appropriate,\u201d she said.\r\n\r\n\u201cIt is not clear to the Court whether Defendant repeatedly failed to meet his disclosure obligations intentionally or due to his unfamiliarity with the federal rules,\u201d Robinson added. \u201cTherefore, the court finds that an additional sanction is appropriate in the form of Continuing Legal Education. Defendant chose to represent his own office in this matter, and as such, had a duty to familiarize himself with the governing rules of procedure, and to ensure as the lead attorney on this case that his discovery obligations were satisfied despite his many duties as a busy public servant.\u201d\r\n\r\nUnder Robinson\u2019s order, Kobach, a Yale Law School graduate, will have to complete six hours of refresher training on legal procedure.\r\n\r\nThe ruling was the latest in a series of public setbacks for Kobach, who a year ago was vice chairman of a presidential commission created to bolster President Trump\u2019s claim that millions of people voted illegally in the 2016 election. The commission was disbanded amid a firestorm of criticism over its request that states provide it with a wide variety of personal information about voters.
