Even before a single ballot was cast in the 2020 presidential election, the Trump campaign and its supporters were leveling unfounded accusations of voter fraud against voting-by-mail across the country, and specifically in <\/span><a href=\"https:\/\/www.forbes.com\/sites\/saradorn\/2022\/11\/01\/trump-claims-pennsylvania-is-sending-out-unverified-ballots-heres-why-thats-false\/?sh=414eefa34f9a\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">Pennsylvania<\/span><\/a><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\r\n\r\n<span data-contrast=\"auto\">With millions of votes cast by mail since 2020, it\u2019s clear that vote-by-mail is popular with voters. Yet Republican opponents have tried countless tactics to dismantle or even overturn the law. Certain Republican legislators \u2013 <\/span><a href=\"https:\/\/www.npr.org\/2022\/05\/16\/1096943765\/some-pennsylvania-lawmakers-who-helped-pass-mail-in-voting-law-now-want-it-throw\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">including some who voted in favor of Act 77<\/span><\/a><span data-contrast=\"auto\"> \u2013 have been relentless in their attempts to take away this popular mode of voting. \u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\r\n\r\n<span data-contrast=\"auto\">Most of the challenges to vote-by-mail in Pennsylvania have failed. Over and over again, the courts have reaffirmed that mail voting is a legal, safe, and convenient way for Pennsylvania\u2019s voters to cast their ballots. Most recently, this past June, Pennsylvania\u2019s Commonwealth Court <\/span><a href=\"https:\/\/statesuniteddemocracy.org\/resources\/bonner-v-chapman\/\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">ruled in favor<\/span><\/a> <span data-contrast=\"auto\">of preserving vote-by-mail in <\/span><i><span data-contrast=\"auto\">Bonner v. Chapman<\/span><\/i><span data-contrast=\"auto\">. In the case, opponents of voting-by-mail had argued that since another court had ruled Act 77\u2019s provision requiring a handwritten signature on the outer mailing envelope was unenforceable,<\/span> <span data-contrast=\"auto\">the whole law should be considered unconstitutional. Thankfully, the Commonwealth Court rejected this argument, leaving mail voting in place. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\r\n\r\n<span data-contrast=\"auto\">This case was not the first, nor will it be the last challenge to Act 77\u2019s vote-by-mail provisions. This law has been the target of dozens of lawsuits, and more suits are expected as we move into the 2024 election season. It\u2019s important for those who value free and fair elections to understand the impact these cases can have on a voter\u2019s right and ability to cast a ballot. We need look no further than the 2023 municipal election to understand the danger of these unending attacks. Here are some examples of <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\r\n<h3><b><span data-contrast=\"auto\">Dating mail ballots<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/h3>\r\n<span data-contrast=\"auto\">Less than a week before the 2023 general election, a decision by the Pennsylvania Supreme Court in a case involving undated mail ballot envelopes threatened to disenfranchise thousands of Pennsylvania voters.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\r\n\r\n<span data-contrast=\"auto\">In <\/span><i><span data-contrast=\"auto\">Ball v. Chapman, <\/span><\/i><span data-contrast=\"auto\">a deadlocked court ruled in a 3-3 decision that counties were to reject ballots with missing or incorrect dates on ballot return envelopes. This decision came after thousands of ballots had already been cast and returned to their county election offices, resulting in many voters being disenfranchised. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\r\n<h3><b><span data-contrast=\"auto\">Notice and cure<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/h3>\r\n<span data-contrast=\"auto\">In Pennsylvania, counties <\/span><i><span data-contrast=\"auto\">may<\/span><\/i><span data-contrast=\"auto\"> allow voters to fix, or \u201ccure\u201d their ballots before Election Day, but they are not required to do so. This unclear standard means that your opportunity to have your vote count can depend on the county that you live in. In yet another lawsuit, <\/span><i><span data-contrast=\"auto\">Republican National Committee v. Chapman, the <\/span><\/i><span data-contrast=\"auto\">Commonwealth Court ruled and the Pennsylvania Supreme Court affirmed that counties could exercise their own judgment over whether to notify voters of a problem and allow them to fix it.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\r\n\r\n<span data-contrast=\"auto\">This led to <\/span><a href=\"https:\/\/www.spotlightpa.org\/news\/2023\/02\/pa-2022-election-drop-box-mail-ballot-curing-scorecard\/?utm_source=Spotlight+PA&amp;utm_campaign=f6487a2a1c-See+which+Pa.+counties+disenfranchised+voters&amp;utm_medium=email&amp;utm_term=0_6c1fbeb603-f6487a2a1c-219635574&amp;mc_cid=f6487a2a1c&amp;mc_eid=a203713a52\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">unequal access<\/span><\/a><span data-contrast=\"auto\"> to the ballot:\u00a0some voters were notified and allowed to fix their ballots, and some were not. Even with the ability to cure ballots, the sheer number of rejections \u2014 due to the ruling being issued right before Election Day \u2014\u00a0resulted in thousands of voters being disenfranchised. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\r\n\r\n<span data-contrast=\"auto\">An <\/span><a href=\"https:\/\/www.spotlightpa.org\/news\/2023\/06\/pa-philadelphia-mail-ballot-rejection-black-latino\/\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">analysis<\/span><\/a><span data-contrast=\"auto\"> of the ballots rejected in Philadelphia revealed that voters of color were disproportionately impacted by rejections due to minor errors like forgetting to handwrite a date on an envelope. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\r\n<h3><b><span data-contrast=\"auto\">Drop boxes<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/h3>\r\n<span data-contrast=\"auto\">Ballot drop boxes are another flashpoint for this fight for the right to vote by mail, and several lawsuits have threatened to curtail their use. So far, all of them have failed; however \u2013 once again \u2013 counties are given complete discretion over whether to use ballot drop boxes, leading to unequal access for voters. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\r\n\r\n<span data-contrast=\"auto\">Republicans in the state legislature \u2013 many of whom voted for Act 77 \u2013 have been equally relentless in their attacks on vote-by-mail, even going so far as to invite election conspiracy theorists to <\/span><a href=\"https:\/\/stategovernment.pasenategop.com\/sg-0329\/\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">promote their anti-drop box rhetoric at public hearings.<\/span><\/a><span data-contrast=\"auto\"> Two dozen bills were introduced last session to roll-back or eliminate the right to vote-by-mail, and Republicans have reintroduced some of them this session.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\r\n\r\n<span data-contrast=\"auto\">Vote-by-mail is a safe, convenient, and popular way for voters to cast their ballots. Election conspiracy theorists and sore losers may try to disrupt our elections and cast doubt on the security of voting by mail, but we have the power as voters to reject those falsehoods.
