Er zijn 342 charterscholen in onze staat. Het publiek verdient meer transparantie en verantwoording rondom deze belangrijke en groeiende sector van het openbaar gefinancierde onderwijssysteem van de staat. Het vaststellen van een duidelijke verplichting tot financi\u00eble openbaarmaking voor charterscholen valt niet buiten de bevoegdheid \u2013 zowel wettelijk als reglementair \u2013 van de Ohio Ethics Commission.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Financi\u00eble openbaarmakingsverklaringen stellen het publiek in staat belangenconflicten te identificeren en bevorderen zo verantwoording: de verklaringen herinneren degenen die verantwoordelijk zijn voor de besteding van belastinggeld eraan dat ze hun eigen financi\u00eble belangen moeten scheiden van hun publieke verantwoordelijkheden en belangenconflicten moeten vermijden.\u00a0<\/span>\r\n\r\n<a href=\"https:\/\/codes.ohio.gov\/ohio-revised-code\/section-102.02\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">ORC 102.02(A)<\/span><\/a><span style=\"font-weight: 400;\"> Het document somt specifiek verschillende soorten overheidsfunctionarissen op die zich moeten aanmelden, waaronder een minimumbevolkingsgrens van 12.000 leerlingen voor leden van traditionele schoolbesturen. <\/span><span style=\"font-weight: 400;\">Aanvullend, <\/span><span style=\"font-weight: 400;\">ORC 102.02(A)<\/span><span style=\"font-weight: 400;\"> vereist <\/span><span style=\"font-weight: 400;\">Alle schooldirecteuren en bedrijfsleiders of penningmeesters moeten jaarlijks een financi\u00eble openbaarmakingsverklaring indienen, ongeacht de omvang van het schooldistrict.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">De ethische commissie van Ohio heeft echter al lange tijd de bevoegdheid om te bepalen welke entiteiten financi\u00eble openbaarmakingsverklaringen moeten indienen. <\/span><a href=\"https:\/\/codes.ohio.gov\/ohio-revised-code\/section-102.02\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">ORC 102.02(B)<\/span><\/a><span style=\"font-weight: 400;\"> waarin is bepaald dat de ethische commissie van Ohio <\/span><i><span style=\"font-weight: 400;\">\u201c&quot;Kan, gebruikmakend van de regelgevingsprocedures van Hoofdstuk 119 van het Herzieningswetboek, van elke categorie openbare functionarissen of werknemers onder haar jurisdictie die niet specifiek door dit artikel zijn uitgesloten en wier functies betrekking hebben op de besteding van openbare middelen, een jaarlijkse verklaring eisen.&quot;\u201d<\/span><\/i><span style=\"font-weight: 400;\">\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Via 119 regelgeving, <\/span><a href=\"https:\/\/codes.ohio.gov\/ohio-administrative-code\/rule-102-5-05\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Ohio Administratieve Code 102-5-05<\/span><\/a><span style=\"font-weight: 400;\"> bepaalt dat financi\u00eble openbaarmakingsverklaringen kunnen worden vereist door een stemming van de ethische commissie van Ohio. De bestuursorganen van gemeenschaps- of charterscholen worden op grond van bestaande jurisprudentie beschouwd als openbare instanties., <\/span><a href=\"https:\/\/www.supremecourt.ohio.gov\/rod\/docs\/pdf\/0\/2010\/2010-ohio-6136.pdf\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Cordray tegen Internationale Voorbereidende School<\/span><\/i><span style=\"font-weight: 400;\">, 2010-Ohio-6136<\/span><\/a><span style=\"font-weight: 400;\"> en kunnen dus worden beschouwd als entiteiten die de ethische commissie van Ohio terecht kan opnemen in de lijst van partijen die verplicht zijn financi\u00eble openbaarmakingsverklaringen in te dienen.\u00a0\u00a0\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Hoewel deze verklaring zich op een specifieke situatie richt, is het belangrijk op te merken dat de wet en de uitgevaardigde regels de Ohio Ethics Commission de onafhankelijkheid geven om te stemmen over en eisen te stellen aan financi\u00eble openbaarmakingsverklaringen om ethische normen in andere overheidssectoren te waarborgen.
