Often dark money organizations are specifically established as 501(c)(4) nonprofits with the IRS to avoid transparency.\u00a0<\/span><\/p>\r\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">More reading: <\/span><a href=\"https:\/\/www.commoncause.org\/ohio\/democracy-wire\/what-is-dark-money-how-did-we-get-here-how-can-we-finally-fix-this-problem\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">What is Dark Money, How Did We Get Here, &amp; How Can We Finally Fix this Problem?<\/span><\/a><\/p>\r\n<p style=\"text-align: left;\"><b>What is racketeering?\u00a0<\/b><\/p>\r\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">Racketeering is a type of <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Organized_crime\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">organized crime<\/span><\/a><span style=\"font-weight: 400;\"> in which the perpetrators set up a coercive, fraudulent, extortionary, or otherwise illegal coordinated scheme or operation<\/span><span style=\"font-weight: 400;\"> (a \"racket\") to repeatedly or consistently collect a profit.<\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Racketeering#cite_note-LouCNN-1\"><span style=\"font-weight: 400;\">[1]<\/span><\/a><\/p>\r\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">The Racketeer Influenced and Corrupt Organizations Act (RICO Act) and state racketeering laws were established to target organized crime. These laws allow prosecution of a group or individual that commits two criminal acts associated with racketeering activity within a 10-year period. Both RICO and Ohio\u2019s own corruption law have expanded to include numerous types of other crimes.<\/span><\/p>\r\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">Detailed RICO definitions and requirements can be found in the <\/span><span style=\"font-weight: 400;\">U.S. Department of Justice\u2019s Manual\u2019s Section 9-110.00, Organized Crime and\u00a0 <\/span><a href=\"https:\/\/www.justice.gov\/jm\/jm-9-110000-organized-crime-and-racketeering\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Organized Crime and Racketeering<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\r\n<p style=\"text-align: left;\"><b>What is a 501(c)(4) non-profit organization?<\/b><\/p>\r\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">According to the IRS, <\/span><span style=\"font-weight: 400;\">501(c)(4) designation is given to tax-exempt, social welfare organizations which must not be organized for profit and must be operated exclusively to promote social welfare. <\/span><span style=\"font-weight: 400;\">These groups are allowed to take part in politics, as long as politics do not become the primary focus. In practice, these groups must spend less than 50 percent of their money on politics. If they adhere to this rule, they can influence elections, which is usually done through advertising.<\/span><\/p>\r\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">Organizations with 501(c)(4) status are regulated by the IRS, not the Federal Elections Commission (FEC); tax-exempt 501(c)(4)s do not need to disclose the source of donations, unlike a political action committee (PAC).<\/span><\/p>\r\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">Multiple 501(c)(4) organizations were established, allegedly, by the racketeering enterprise. The enterprise filtered funds from FirstEnergy, through Generation Now to the network of pass-through tax-exempt organizations.
