Since this fifth set of maps was entirely identical to the <\/span>third set of maps<\/span><\/a> that were struck down by the same court on 3\/16\/2022, the only mystery is why it took the court so long to find these very same maps to be non-compliant with the provisions in the Ohio Constitution, just as they did the last time around.\u00a0\u00a0\u00a0<\/span>\r\n\r\nWhat was that line of Einstein's? Something about the definition of insanity being doing the same thing over and over again and somehow expecting a different outcome? The Republican members of the Ohio Redistricting Commission have that down to a T.\u00a0<\/span>\r\n\r\nSadly, the majority strategy of repeatedly submitting gerrymandered maps while running out the clock is working well for the GOP members of the Ohio Redistricting Commission. <\/b>The federal court, citing concerns about the possible timing of a primary election, already stated that if a new map was not adopted by May 28, they would instruct the Commission to use the third set of maps\u2014even though this set was found to be unconstitutional by the Ohio Supreme Court.\u00a0<\/span>\r\n\r\n\"\"\r\n\r\nThe words of Chief Justice Maureen O\u2019Connor say it best.<\/b> Here are some quotes from her concurring opinion. You can read the whole opinion <\/span>at this link<\/span><\/a>.\u00a0<\/span>\r\n\r\n\u201cThe federal court determined that to avoid jeopardizing Ohioans\u2019 right to vote, it would wait until May 28 before acting. But the federal court did not \u2018stay [its] hand until May 28,\u2019 as it stated it would, and leave the state to fix the crisis created by the commission\u2019s own actions. Instead, <\/span><\/i>the federal court provided the Republican commission members not only a roadmap of how to avoid discharging their duties but also a green light to further delay these proceedings by stating its intention to implement \u201cMap 3\u201d..., all the while acknowledging that this court had declared Map 3 to be invalid and unconstitutional.\u201d<\/i><\/b>\r\n\r\nShe continues: <\/span>\u201c\u2026Lamentably, the federal court\u2019s optimism that the commission members \u2018are public servants who still view partisan advantage as subordinate to the rule of the law,\u2019 proved to be unfounded.\u201d<\/span><\/i>\u00a0\u00a0\u00a0\u00a0<\/span>\r\n\r\n\u201cThe federal court\u2019s statement that this court and the commission might \u2018work together to find a solution\u2019 also erroneously suggests that this court actually has a seat at the commission\u2019s table. Indeed, if Article XI of the Ohio Constitution allowed for this court to have a seat at the commission\u2019s table, perhaps we would not be where we are today, and a constitutionally compliant map would be in place.\u201d<\/span><\/i>\u00a0<\/span>\r\n\r\nSigh.\u00a0<\/span>\r\n\r\nWe know you are all hoping that <\/span>at the very least,<\/b> the commissioners who openly defied the Ohio Supreme Court\u2019s order to draw a new set of maps would be found in contempt. We\u2019re sorry to say that this was not the case. <\/span>The Court found no contempt. <\/b>This defies common sense. It\u2019s a bitter pill to swallow; we\u2019re sorry to be the bearers of the bad news that Senate Preside Huffman and Speaker Cupp will not be sanctioned, fined, or thrown in jail. Lord knows they richly deserve to be punished for openly and repeatedly defying the Ohio Supreme Court, the Constitution, and the voters of Ohio.\u00a0<\/span>\r\n\r\nWhat a terrible precedent is set when our law-makers are allowed to ignore a court order. <\/b>It doesn\u2019t matter what party you belong to or how you vote: we all need and deserve to live in a society where no one is above the law and where even those at the top\u2014ESPECIALLY those at the top\u2014follow the law and are held accountable.\u00a0<\/span>\r\n\r\nWhat will happen next? <\/b>The Ohio Supreme Court ordered new state legislative maps by June 3. But the federal panel of judges already said they would take action if new maps were not in place by May 28. And while we don\u2019t know exactly when the federal panel will act, we do know that the federal court\u2019s order will supersede that of the Ohio Supreme Court.\u00a0<\/span>\r\n\r\nMeanwhile, here is a brief timeline for what to expect in the case over Ohio's congressional map.\r\n
