City of Anderson"},"template":"","class_list":["post-506","work","type-work","status-publish","hentry","work_type-litigation"],"acf":{"details":{"summary":"Common Cause Indiana, the Anderson-Madison County NAACP, the League of Women Voters Indiana, and individual voters filed a lawsuit in federal court, asserting Anderson\u2019s city council districts were malapportioned in violation of federal and state law.","featured_image":"","work_type":157,"related_issues":[62,395],"location":17},"sidebar":{"helper_enable_sidebar":false,"helper_media_contact":{"heading":"Media Contact","manually_enter_person":false,"person":"","name":"","role":"","phone":"","email":""},"helper_links_downloads":{"heading":"Links & Downloads","links":null}},"page_layout":[{"acf_fc_layout":"layout_featured_work","_acfe_flexible_toggle":"","component_featured_work":{"content_type":"work","button_text":"View This Campaign","secondary_link":"","manually_curate":false,"small_title":"","large_title":"","summary":"","button":null,"small_link":null,"image":null}},{"acf_fc_layout":"layout_wysiwyg","_acfe_flexible_toggle":"","component_wysiwyg":{"content":"Final Victory for Fair Maps in Anderson:\u00a0 City Council Finally Passes New District Maps\u00a0<\/strong>\r\n\r\nAfter more than a year and a half of litigation that ultimately cost Anderson taxpayers more than a quarter million dollars, in January 2025 the Anderson City Council finally complied with the federal judge's order to draw new maps that respect the \"on person, one vote\" principle.\u00a0 This is huge victory for Common Cause Indiana and our co-plaintiffs in this lawsuit, the League of Women Voters of Indiana and the Anderson - Madison County branch of the NAACP.\u00a0 We want to thank our attorneys Bill Groth and Daniel Bowman who did an outstanding job.\r\n\r\nIn June of 2023, Common Cause Indiana, the League of Women Voters of Indiana, and the Anderson-Madison County branch of the NAACP filed a lawsuit in federal court to force Anderson, Indiana to redraw its badly malapportioned city council districts.\u00a0<\/span>\u00a0<\/span>\r\n\r\nOn September 30, 2024, a federal judge ruled<\/a> that the Anderson City Council\u2019s failure to redistrict with recent census data violates the U.S. Constitution and that fair maps must be drawn. Before Monday\u2019s ruling, Anderson had not properly redistricted in more than four decades. The Council last redrew its voting map in 1982 and ignored population changes identified in the 1990, 2000, 2010, and 2020 decennial census counts. The City Council has cost taxpayers over $150,000 in legal costs to defend blatantly unconstitutional districts.<\/span>\u00a0<\/span>\r\n\r\nThe ruling awarded summary judgment to the plaintiffs and struck down districts with differences in population far beyond what is allowed under the Fourteenth Amendment\u2019s guarantee of equal protection. The Court relied largely on the statistical analysis done by Sarah Andre, Common Cause\u2019s Redistricting Demography and Mapping Specialist. The opinion concluded that the Anderson districts, with a population deviation of 45.48%, were unconstitutionally malapportioned. The U.S. Supreme Court has ruled that a deviation of more than 10% is presumably unconstitutional unless justified by the government defendants.<\/span>\u00a0<\/span>\r\n\r\nAlthough the Court declined to issue an injunction, citing potential voter confusion during the 2024 elections, Anderson City Council elections will not take place until 2027.
