Notre argumentation juridique<\/h3>\r\nLe 21 juillet 2020, le pr\u00e9sident Donald Trump\u00a0a \u00e9mis un m\u00e9mo<\/a> describing his administration\u2019s intent to implement a discriminatory and unconstitutional policy regarding the census. This memo directed the Secretary of Commerce to provide the President with the information necessary to exclude undocumented people from being counted in upcoming congressional seat allocations.\r\n\r\nOn July 23, 2020, Common Cause sued the\u00a0President in the U.S.\u00a0District\u00a0Court for the District of Columbia. We and our co-plaintiffs challenged this transparent effort to deprive cities and communities with large immigrant populations of equal representation in Congress and to threaten their ability to access federal resources\u00a0that\u00a0rely\u00a0on census data.\u00a0Lire la plainte ici.<\/a>\r\n\r\nThe plain language of the law makes it clear that the Trump Administration\u2019s order is illegal.\u00a0The 14th Amendment requires that the \u201cwhole number of persons in each state\u201d be used to determine the allocation of seats in the House of Representatives, and federal law requires that the Secretary of Commerce send to the President the \u201ctabulation of total population by states\u201d and for the President to then send to Congress a statement showing the \u201cwhole number of persons\u201d in each state.\r\n\r\nOral arguments in the U.S. District Court for the District of Columbia\u00a0a eu lieu le 29 septembre 2020<\/a>. Des plaignants de partout au pays<\/h3>\r\nOutre Common Cause, les plaignants gouvernementaux comprenaient les villes d'Atlanta (G\u00e9orgie), Clarkston (G\u00e9orgie), Dayton (Ohio), El Paso (Texas), Paterson (New Jersey), Portland (Oregon), South Pasadena (Californie) et El Monte Union High School District (Californie).
