This executive order would create new bureaucratic hurdles that make it harder for our citizens to register to vote and cast a ballot that counts. Election administration should focus on expanding access to the ballot, not gift wrapping our freedoms and handing them to Trump\u2019s billionaire friends.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li>\r\n<\/ul>\r\n<h3><b><span data-contrast=\"auto\">The Big Lie<\/span><\/b><span data-ccp-props=\"{}\">\u00a0<\/span><\/h3>\r\n<span data-contrast=\"auto\">Any effort by Donald Trump to make it harder for Americans to vote must always be viewed in the context of his bruised ego. Being the sitting president of the United States is insufficient to ease the pain of losing the popular vote in 2016 and the presidency in 2020, so he insists on inventing an excuse. We know this because of the <\/span><a href=\"https:\/\/www.npr.org\/2024\/10\/11\/nx-s1-5147732\/voter-fraud-explainer\"><span data-contrast=\"none\">complete lack of evidence<\/span><\/a><span data-contrast=\"auto\"> that unlawful voting is a problem. In fact, voting by an ineligible person is so exceedingly rare that there is no evidence in a single modern election at any level of government, including <\/span><a href=\"https:\/\/www.washingtonpost.com\/news\/the-fix\/wp\/2016\/12\/01\/0-000002-percent-of-all-the-ballots-cast-in-the-2016-election-were-fraudulent\/\"><span data-contrast=\"none\">2016<\/span><\/a><span data-contrast=\"auto\"> and <\/span><a href=\"https:\/\/apnews.com\/article\/voter-fraud-election-2020-joe-biden-donald-trump-7fcb6f134e528fee8237c7601db3328f\"><span data-contrast=\"none\">2020<\/span><\/a><span data-contrast=\"auto\">, that it has even come close to impacting the outcome. The risk of felony charges is sufficient to convince the public that casting a single unlawful vote among many is simply not worth the risk.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span>\r\n\r\n<span data-contrast=\"auto\">Trump has already demonstrated how far he will go to soothe his ego and maintain power. On January 6, 2021, Trump was willing to <\/span><a href=\"https:\/\/january6th-benniethompson.house.gov\/\"><span data-contrast=\"none\">incite a treasonous riot at the U.S. Capitol<\/span><\/a><span data-contrast=\"auto\"> and end a 160-year streak in which power was transferred peacefully between presidents. Given this fact, it is unsurprising that he would also strengthen his big lie about the 2016 and 2020 elections by threatening the voting rights of millions of Americans.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span>\r\n<h4><b><span data-contrast=\"auto\">New Red Tape for Americans Registering to Vote<\/span><\/b><span data-ccp-props=\"{}\">\u00a0<\/span><\/h4>\r\n<span data-contrast=\"auto\">Trump\u2019s \u201corder\u201d purports to force the Election Assistance Commission (EAC) to require those who use the <\/span><a href=\"https:\/\/www.eac.gov\/voters\/national-mail-voter-registration-form\"><span data-contrast=\"none\">national mail voter registration form<\/span><\/a><span data-contrast=\"auto\"> to submit documentary proof of citizenship. Question 6 of this form already allows states to specify an identification number such as the applicant\u2019s driver license or the last four digits of the applicant\u2019s social security number. Although most Americans register to vote using state forms and not the federal form Trump sought to alter, it is still an unlawful power grab and an attack on voting rights. <\/span><span data-ccp-props=\"{}\">\u00a0<\/span>\r\n\r\n<span data-contrast=\"auto\">The most glaring legal problem with this executive order is that Trump lacks any authority to change the rules of federal elections. The <\/span><a href=\"https:\/\/constitution.congress.gov\/browse\/article-1\/section-4\/clause-1\/\"><span data-contrast=\"none\">U.S. Constitution empowers states and Congress<\/span><\/a><span data-contrast=\"auto\"> to determine the \u201cTimes, Places, and Manner\u201d of federal election with no mention of the president. In addition, the EAC was created to be an <\/span><a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/52\/20921\"><span data-contrast=\"none\">independent agency<\/span><\/a><span data-contrast=\"auto\"> that is no way under the control of the president. The EAC <\/span><a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/52\/20923\"><span data-contrast=\"none\">consists of two Democrats and two Republicans<\/span><\/a><span data-contrast=\"auto\">, with official actions <\/span><a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/52\/20928\"><span data-contrast=\"none\">requiring the agreement of three of four commissioners<\/span><\/a><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span>\r\n\r\n<span data-contrast=\"auto\">In addition, the contents of the federal voter registration form are <\/span><a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/52\/20508#a_2\"><span data-contrast=\"none\">established by federal law<\/span><\/a><span data-contrast=\"auto\"> and must be changed by federal law, not presidential fiat. Trump could sign an executive order \u201crequiring\u201d the mayor of New York to paint the Statue of Liberty the same shade of gold as his Mar-a-Lago bathroom fixtures, but that doesn\u2019t mean he has any authority to do so. <\/span><span data-ccp-props=\"{}\">\u00a0<\/span>\r\n\r\n<span data-contrast=\"auto\">Aside from fatal legal flaws, this executive order would demand proof of citizenship that most Americans do not have. The executive order lists passports, REAL IDs, military IDs, and other undefined federal or state IDs that indicate citizenship status. An additional <\/span><a href=\"https:\/\/www.ncsl.org\/elections-and-campaigns\/table-2-excuses-to-vote-absentee\"><span data-contrast=\"none\">14 states<\/span><\/a><span data-contrast=\"auto\">\u00a0allow voters to request a mail ballot if they provide an allowable excuse under state law. Trump\u2019s executive order seeks to throw away these mail ballots if they happen to arrive after Election Day even if they are mailed on or before Election Day. The order calls on the attorney general of the United States to take \u201call necessary action\u201d against states that count these ballots in federal elections. <\/span><span data-ccp-props=\"{}\">\u00a0<\/span>\r\n\r\n<a href=\"https:\/\/www.ncsl.org\/elections-and-campaigns\/table-11-receipt-and-postmark-deadlines-for-absentee-mail-ballots\"><span data-contrast=\"none\">Seventeen states and the District of Columbia<\/span><\/a><span data-contrast=\"auto\"> currently count mail ballots that are postmarked by Election Day. This makes sense since the speed of mail delivery should not dictate an American\u2019s right to have their vote counted. The president\u2019s executive order would create an arbitrary rule that disenfranchises millions of Americans against the wishes of 18 jurisdictions of all political stripes with no logical justification related to improving election integrity.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span>\r\n<h4><b><span data-contrast=\"auto\">Taking a Chainsaw to Voter Registration Records<\/span><\/b><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:1,&quot;335551620&quot;:1,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/h4>\r\n<span data-contrast=\"auto\">Another provision of this executive order requires the Department of Homeland Security to work with Elon Musk\u2019s DOGE to pry into states\u2019 voter registration records. So far, DOGE\u2019s track record is dominated by loud proclamations of cutting waste in government that turned out to be wrong and were then corrected as quietly as possible. This includes, according to <\/span><a href=\"https:\/\/www.npr.org\/2025\/03\/01\/nx-s1-5313853\/doge-savings-receipts-musk-trump\"><span data-contrast=\"none\">an NPR report<\/span><\/a><span data-contrast=\"auto\">, a typo causing a calculation to be $8 billion off, triple counting a USAID project it cut, and cancelled contracts that were never actually cancelled. Several weeks ago, the DOGE website <\/span><a href=\"https:\/\/www.reuters.com\/world\/us\/doge-website-offers-error-filled-window-into-musks-government-overhaul-2025-03-04\/\"><span data-contrast=\"none\">deleted the top five largest money-saving projects<\/span><\/a><span data-contrast=\"auto\"> it claimed to be responsible for after determining they were all wrong.
