We are opposing them because they will\u00a0 have a chilling effect on essential journalism that sheds light on corruption and enables Floridians to hold our\u00a0 officials accountable. Ordinary Floridians who post on social media could also be caught up in these changes to\u00a0 the law. By enabling costly frivolous lawsuits, these bills would force journalists to consider the cost of litigation\u00a0 for every investigative piece they publish and potentially reveal their sources to avoid liability. This would impact\u00a0 media across the political spectrum, particularly local reporters whom Floridians rely on and who don\u2019t have the\u00a0 financial resources to risk being sued. These bills are both in their last committees before heading to a vote by the\u00a0 full House and Senate. <\/span><b>Tell your representatives to vote NO on SB 1780 and HB 757.\u00a0<\/b>\r\n\r\n<span style=\"font-weight: 400;\">Two bills are seeking to address <\/span><b>Artificial Intelligence Use in Political Advertising (SB 850 and HB 919)<\/b><span style=\"font-weight: 400;\">. The danger\u00a0 that AI-based disinformation poses to voters this year should not be underestimated. Unfortunately, these bills\u00a0 are a fig leaf instead of a solution. The disclaimer these bills would require is very weak and doesn\u2019t say the content\u00a0 was manipulated with AI or that it doesn\u2019t depict real events. As is, the disclaimer fails to inform Floridians that\u00a0 they are being manipulated. Even worse, these bills do not include any provision for injunctive relief to get\u00a0 manipulative political advertisements taken down as fast as possible, leaving Floridians exposed to the harms of\u00a0 the deceptive content while the complaint process plays out. <\/span><b>SB 850 and HB 919 are both headed to a vote by\u00a0 the full House and Senate: tell your representatives to make these bills stronger so that Floridians have REAL\u00a0 protection from AI-generated manipulation.<\/b>\r\n\r\n&nbsp;\r\n\r\n<img class=\"alignnone size-full wp-image-1718\" src=\"https:\/\/www.commoncause.org\/florida\/wp-content\/uploads\/sites\/8\/2018\/03\/MA-topper-disclosure-transparency.jpg\" alt=\"\" width=\"1500\" height=\"1039\" \/>\r\n\r\n&nbsp;\r\n<a id=\"moneyinpolitics\"><\/a>\r\n<h2><b>Money in Politics<\/b><b>\u00a0<\/b><\/h2>\r\n<span style=\"font-weight: 400;\">Poison pill amendments were added to the <\/span><b>Senate Ethics bill (SB 7014) <\/b><span style=\"font-weight: 400;\">at the last minute before passage, transforming it into a bill that will have disastrous effects on investigation of corruption and enforcement of\u00a0 Florida\u2019s Sunshine Laws. The bill now requires all ethics complaints to be \u201cbased upon personal knowledge\u201d and\u00a0 strips local ethics boards of their ability to initiate a complaint. Shutting down investigations based on reports\u00a0 from anonymous credible whistleblowers and relying on people with \u201cpersonal knowledge\u201d to come forward\u00a0 publicly will paralyze the ability to stop ethics violations. The dangerous amendments have not yet been added to\u00a0 the <\/span><b>House Ethics bill (HB 1597)<\/b><span style=\"font-weight: 400;\">, which has one more committee stop. <\/span><b>Tell your House representative to defend\u00a0 Florida\u2019s ability to investigate ethics violations and reject any \u201cpersonal knowledge\u201d requirement in HB 1597.\u00a0<\/b>\r\n\r\n<b>SJR 1114 and HJR 7059 are proposing to remove public campaign financing from the Florida Constitution <\/b><span style=\"font-weight: 400;\">by <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">making Floridians go back to the ballot on this issue for a third time. Floridians put this in our Constitution in 1998, <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">and we re-affirmed our support for it in 2010, because we know wealthy special interests have too much power <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">in politics and we know public campaign financing gives small-dollar donors and ordinary Floridians a bigger voice. <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">According to current Florida law, \u201cthe purpose of public campaign financing is to make candidates more <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">responsive to the voters of the State of Florida and as insulated as possible from special interest groups.\u201d That\u2019s <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">the program the legislature is proposing to get rid of entirely, instead of using their existing power to make it <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">better. <\/span><b>These resolutions are both headed to a vote in the full House and Senate: tell your representatives to <\/b><b>vote NO o<\/b><b>n SJR 1114 and HJR 7059.<\/b>\r\n\r\n&nbsp;\r\n<h2><b><img class=\"alignnone size-full wp-image-8871\" src=\"https:\/\/www.commoncause.org\/florida\/wp-content\/uploads\/sites\/8\/2024\/02\/GettyImages-1064737648.jpg\" alt=\"\" width=\"2048\" height=\"1451\" \/><\/b><\/h2>\r\n&nbsp;\r\n\r\n<a id=\"votingelections\"><\/a>\r\n<h2>Voting &amp; Elections<\/h2>\r\n<span style=\"font-weight: 400;\">There are some <\/span><i><span style=\"font-weight: 400;\">great <\/span><\/i><span style=\"font-weight: 400;\">voting and elections bills that have been filed this session! While we unfortunately don\u2019t\u00a0 expect these bills to receive a hearing this year, they are important pro-voter measures that we can work towards\u00a0 and fight for to ensure truly free and fair elections in Florida. <\/span><b>Make sure your representatives are <\/b><b>supporting <\/b><b>and\u00a0 <\/b><b>co-sponsoring <\/b><b>these good elections bills:\u00a0<\/b>\r\n<ul>\r\n \t<li><b>The Harry T. &amp; Harriette V. Moore Florida Voting Rights Act (HB 1035 \/ SB 1522) <\/b><span style=\"font-weight: 400;\">would remove the voting\u00a0 barriers that have been erected over the past 5 years, expand voting access for Floridians in new ways,\u00a0 and put in place comprehensive protections for Florida voters.\u00a0<\/span><\/li>\r\n \t<li><b>The Florida Language Access in Elections Bill (HB 1423 \/ SB 1670) <\/b><span style=\"font-weight: 400;\">would put in place comprehensive\u00a0 assistance for voters who are not proficient in English, helping ensure that no voter in Florida is\u00a0 disenfranchised because of the language they speak.\u00a0<\/span><\/li>\r\n \t<li><b>Advisory Opinions on Voter Eligibility (HB 1525 \/ SB 904) <\/b><span style=\"font-weight: 400;\">seeks to address the fact that Florida\u2019s current\u00a0 voting process is broken for returning citizens. This bill would require the Department of State to provide\u00a0 returning citizens with clarity on their eligibility to vote within 90 days of the returning citizen requesting\u00a0 an advisory opinion.\u00a0\u00a0<\/span><\/li>\r\n<\/ul>\r\n<span style=\"font-weight: 400;\">Some <\/span><b>problematic elections bills <\/b><span style=\"font-weight: 400;\">are moving through the legislative process. Common Cause opposes <\/span><b>SB 438 and\u00a0 HB 57 on County Commissioner Term Limits <\/b><span style=\"font-weight: 400;\">because it takes time to learn how governing works, so term limits\u00a0 like this often mean that staff and lobbyists \u2013 not elected representatives \u2013 are running the show. <\/span><b>SB 782 and HB\u00a0 965 on Election Board Composition <\/b><span style=\"font-weight: 400;\">has a great intention behind it in trying to ensure representation of both\u00a0 Republican and Democrat poll workers at every polling location. But we\u2019re concerned about what will happen if\u00a0 there aren\u2019t enough poll workers from one of these parties, and we think NPA or minor party poll workers should\u00a0 be able to fill in to prevent a polling location from having to be closed due to this policy. <\/span><b>HB 7003 and SB 7010\u00a0 <\/b><span style=\"font-weight: 400;\">have both passed, allowing voters\u2019 personal data to be shared with other government entities for election\u00a0 administration purposes. This provision would appear to be needed, in part, because Florida has left the Electronic\u00a0 Registration Information Center (ERIC). When Florida joined ERIC, there were requirements around security of\u00a0 Floridians\u2019 data. This bill does not provide any such requirements \u2013 we will monitor its implementation to ensure\u00a0 it does.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Several <\/span><b>very dangerous elections bills <\/b><span style=\"font-weight: 400;\">have also been filed this session. So far none of these have moved forward,\u00a0 which we hope means the legislature has taken the wise advice of Florida\u2019s Supervisors of Elections to not change\u00a0 the rules in a major election year. However, we will keep a careful eye on these bills right through to the end of\u00a0 session and let you know if you need to take action: <\/span><b>HB 359 <\/b><span style=\"font-weight: 400;\">would allow for hand counting of ballots, which is bad\u00a0 for fair and secure elections because it is slower, more prone to errors, and more expensive than counting paper\u00a0 ballots with machines. <\/span><b>SB 1602 <\/b><span style=\"font-weight: 400;\">would impose identity requirements that risk disenfranchising new and naturalized\u00a0 citizens, renters, students, people with disabilities, military and overseas voters, and anyone who doesn\u2019t have a\u00a0 Florida driver license. <\/span><b>SB 1752 <\/b><span style=\"font-weight: 400;\">would abolish voting by mail as we know it, impacting millions of Floridians who\u00a0 rely on vote-by-mail ballots. <\/span><b>HB 1669 <\/b><span style=\"font-weight: 400;\">would impose a host of new, unnecessary and potentially impossible election\u00a0 administration requirements. <\/span><b>SB 190 and HB 671 <\/b><span style=\"font-weight: 400;\">would require very expensive and unnecessary law enforcement\u00a0 oversight of ballot boxes.\u00a0\u00a0<\/span>\r\n\r\n&nbsp;\r\n<a id=\"callsforanarticlevconvention\"><\/a>\r\n<h2><b>Calls for an Article V Convention<\/b><b>\u00a0<\/b><\/h2>\r\n<span style=\"font-weight: 400;\">Four resolutions are re-upping Florida\u2019s calls for a dangerous Article V Convention: Balanced Federal Budget (HCR\u00a0 703 and SCR 324), Congressional Term Limits (HCR 693 and SCR 326), Equal Application of the Law (HCR 7055 and\u00a0 SCR 7066), and Line-item Veto (HCR 7057 and SCR 7064).\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Under Article V of the U.S. Constitution, Congress is required to hold a constitutional convention if two-thirds of\u00a0 state legislatures call for one. However, there are no rules for an Article V Convention outlined in the Constitution.\u00a0 <\/span><span style=\"font-weight: 400;\">That\u2019s why leaders on both the left and right are concerned about a runaway convention that could revoke our <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">hard-won rights and freedoms. <\/span><span style=\"font-weight: 400;\">There are no rules limiting the convention to the individual issues listed in these\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">resolutions. There are no rules preventing corporations from pouring money in to influence delegates or the\u00a0 selection of delegates. And there are no rules about how decisions will be made. <\/span><span style=\"font-weight: 400;\">Regardless of opinions on the <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">individual issues addressed in these resolutions, most Floridians would agree that these things are not worth <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">opening the entire U.S. Constitution and Bill of Rights up to revision in a forum that risks being hijacked by wealthy <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">and ideological special interests. <\/span><span style=\"font-weight: 400;\">Balanced Federal Budget and Congressional Term Limits have already passed\u00a0 both houses, there is still time to <\/span><b>tell your representatives to vote NO on Equal Application of the Law (HCR 7055\u00a0 and SCR 7066) and Line-item Veto (HCR 7057 and SCR 7064)<\/b><span style=\"font-weight: 400;\">.<\/span>\r\n\r\n&nbsp;\r\n\r\n<img class=\"size-full wp-image-8872\" src=\"https:\/\/www.commoncause.org\/florida\/wp-content\/uploads\/sites\/8\/2024\/02\/Stock-1.jpeg\" alt=\"\" width=\"2048\" height=\"1305\" \/>\r\n\r\n&nbsp;\r\n<a id=\"ballotinitiativeproces\"><\/a>\r\n<h2>Ballot Initiative Process<\/h2>\r\n<b>HJR 335 <\/b><span style=\"font-weight: 400;\">is seeking to put an amendment on the November 2024 ballot asking voters to approve increasing the\u00a0 threshold to approve new constitutional amendments from 60% to 66.67%. This proposal rigs the game against\u00a0 everyday Floridians and is a power grab on one of the few checks citizens have on an unresponsive legislature.\u00a0 Making the amendment process even harder will make it almost impossible for anyone except big-money special\u00a0 interests to pass a ballot initiative in Florida. At the 66.67% level, Floridians would not have been able to put in\u00a0 place important popular reforms, like Raising Florida\u2019s Minimum Wage. The increased percentage would\u00a0 disproportionately impact the ability of ordinary groups of Floridians to successfully pass citizens\u2019 initiatives\u00a0 because the initiative process is already much more difficult and expensive than the process for the legislature to\u00a0 put an amendment on the ballot. <\/span><b>This resolution has so far not moved forward, but we will keep watching it\u00a0 and let you know if you need to tell your representative to vote NO on HJR 335.<\/b>"}},{"acf_fc_layout":"layout_add_component","_acfe_flexible_toggle":"","component_add_component":null},{"acf_fc_layout":"layout_work","_acfe_flexible_toggle":"","component_work":{"heading":"Work","manually_curate":false,"work":null}},{"acf_fc_layout":"layout_related_articles","_acfe_flexible_toggle":"","component_related_articles":{"heading":"Updates","button_text":"See all Related Articles","manually_curate":true,"articles":["{\"site_id\":\"45\",\"post_type\":\"article\",\"post_id\":281}","{\"site_id\":\"45\",\"post_type\":\"article\",\"post_id\":276}"]}}]},"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v26.6 (Yoast SEO v27.1.1) -
