Si les r\u00e8gles ne sont pas respect\u00e9es, il existe des motifs de recours judiciaire.\r\n<div class=\"page\" title=\"Page 1\">\r\n<div class=\"layoutArea\">\r\n<div class=\"column\">\r\n\r\n<em>Crit\u00e8res de niveau 1 :<\/em>\r\n<div class=\"page\" title=\"Page 1\">\r\n<div class=\"layoutArea\">\r\n<div class=\"column\">\r\n<ul>\r\n \t<li>Aucun plan de r\u00e9partition ou district ne doit \u00eatre \u00e9tabli dans l&#039;intention de favoriser ou de d\u00e9favoriser un parti politique ou un titulaire - pas de d\u00e9coupage \u00e9lectoral partisan ; et<\/li>\r\n \t<li>Les districts ne doivent pas \u00eatre dessin\u00e9s dans l&#039;intention ou avec pour r\u00e9sultat de nier ou de restreindre l&#039;\u00e9galit\u00e9 des chances des minorit\u00e9s raciales ou linguistiques de participer au processus politique ou de diminuer leur capacit\u00e9 \u00e0 \u00e9lire des repr\u00e9sentants de leur choix - pas de d\u00e9coupage \u00e9lectoral racial.<\/li>\r\n<\/ul>\r\n<div class=\"page\" title=\"Page 1\">\r\n<div class=\"layoutArea\">\r\n<div class=\"column\">\r\n\r\n<em>Crit\u00e8res de niveau 2 (\u00e0 respecter sauf si cela entre en conflit avec les normes de niveau 1 ou la loi f\u00e9d\u00e9rale) :<\/em>\r\n<ul>\r\n \t<li>Les districts sont constitu\u00e9s de territoires contigu\u00ebs;<\/li>\r\n \t<li>Les districts doivent avoir une population aussi \u00e9gale que possible ;<\/li>\r\n \t<li>Les districts doivent \u00eatre compacts ; et<\/li>\r\n \t<li>Les limites des districts doivent, dans la mesure du possible, suivre les fronti\u00e8res politiques et g\u00e9ographiques existantes.<\/li>\r\n<\/ul>\r\n<div class=\"page\" title=\"Page 1\">\r\n<div class=\"layoutArea\">\r\n<div class=\"column\">\r\n<h3><strong>Le processus d&#039;adoption d&#039;un plan de red\u00e9coupage \u00e9lectoral<\/strong><\/h3>\r\nAlors que le processus officiel de red\u00e9coupage des circonscriptions en Floride commence en 2021 avec des r\u00e9unions du comit\u00e9 l\u00e9gislatif et des audiences publiques, les cartes seront approuv\u00e9es au cours de la session l\u00e9gislative de 2022.\r\n<ul>\r\n \t<li>Peu apr\u00e8s les \u00e9lections de 2020, la Chambre des repr\u00e9sentants de Floride nommera son Comit\u00e9 de red\u00e9coupage et le S\u00e9nat nommera son Comit\u00e9 de r\u00e9affectation. Tous deux seront dot\u00e9s d&#039;un personnel complet d&#039;experts en cartographie et du personnel de soutien n\u00e9cessaire. Ces comit\u00e9s devraient commencer \u00e0 se r\u00e9unir d\u00e8s le d\u00e9but des semaines de travail.<\/li>\r\n \t<li>Par le pass\u00e9, dans des circonstances normales, les deux comit\u00e9s ont tenu des audiences publiques au printemps et \u00e0 l\u2019\u00e9t\u00e9 pr\u00e9c\u00e9dant l\u2019ann\u00e9e o\u00f9 les cartes devaient \u00eatre adopt\u00e9es. Ces audiences ne sont pas exig\u00e9es par la loi et sont soumises aux restrictions impos\u00e9es par la pand\u00e9mie de COVID-19.<\/li>\r\n \t<li>Les cartes sont cens\u00e9es \u00eatre dessin\u00e9es par le personnel ou les membres du comit\u00e9, puis approuv\u00e9es par le comit\u00e9 (et ses sous-comit\u00e9s). Le Comit\u00e9 de red\u00e9coupage de la Chambre est responsable de la carte de la Chambre, et le Comit\u00e9 de red\u00e9coupage du S\u00e9nat est responsable de la carte du S\u00e9nat. Les deux chambres sont responsables de la carte du Congr\u00e8s. Les trois cartes doivent \u00eatre approuv\u00e9es par la majorit\u00e9 des deux chambres.<\/li>\r\n \t<li>Les cartes de la Chambre et du S\u00e9nat de Floride sont adopt\u00e9es sous forme de r\u00e9solutions conjointes et la Cour supr\u00eame de Floride est constitutionnellement tenue de les examiner pour en v\u00e9rifier la validit\u00e9 apparente dans un d\u00e9lai de 30 jours.<\/li>\r\n \t<li>La carte du Congr\u00e8s est adopt\u00e9e comme un projet de loi ordinaire et est soumise \u00e0 l&#039;approbation ou au veto du gouverneur selon le processus utilis\u00e9 pour tout autre projet de loi.<\/li>\r\n \t<li>Apr\u00e8s examen par la Cour supr\u00eame et signature du gouverneur, les cartes peuvent \u00eatre contest\u00e9es devant un tribunal de premi\u00e8re instance. Le tribunal comp\u00e9tent (\u00e9tatique ou f\u00e9d\u00e9ral) d\u00e9pend du motif de la contestation.<\/li>\r\n<\/ul>\r\n<div class=\"page\" title=\"Page 2\">\r\n<div class=\"layoutArea\">\r\n<div class=\"column\">\r\n<h3>Que se passe-t-il si l\u2019assembl\u00e9e l\u00e9gislative de l\u2019\u00c9tat ne parvient pas \u00e0 s\u2019entendre sur un plan de red\u00e9coupage l\u00e9gislatif ou si un tribunal invalide un plan ?<\/h3>\r\nSi un plan de red\u00e9coupage n&#039;est pas adopt\u00e9 ou est rejet\u00e9 apr\u00e8s examen par un tribunal, la Constitution exige que l&#039;assembl\u00e9e l\u00e9gislative tienne une session de 15 jours pour approuver un nouveau plan. Si le deuxi\u00e8me plan n&#039;est pas adopt\u00e9 par le tribunal ou si l&#039;assembl\u00e9e l\u00e9gislative ne parvient pas \u00e0 approuver un nouveau plan dans les 15 jours, le tribunal dispose de 60 jours pour adopter un plan alternatif.\r\n<div class=\"page\" title=\"Page 2\">\r\n<div class=\"layoutArea\">\r\n<div class=\"column\">\r\n<h3>Que se passe-t-il si l\u2019assembl\u00e9e l\u00e9gislative de l\u2019\u00c9tat ne parvient pas \u00e0 se mettre d\u2019accord sur un plan de red\u00e9coupage des circonscriptions du Congr\u00e8s ou si le gouverneur oppose son veto au plan ?<\/h3>\r\nIl n\u2019existe aucune proc\u00e9dure constitutionnelle permettant de d\u00e9terminer ce qui se passe si le gouverneur oppose son veto au plan de red\u00e9coupage ou si le Parlement ne parvient pas \u00e0 s\u2019entendre sur un plan du Congr\u00e8s. Lors du cycle de red\u00e9coupage de 2012, des sessions sp\u00e9ciales ont \u00e9t\u00e9 organis\u00e9es pour tenter d\u2019adopter un nouveau plan apr\u00e8s que le plan initial ait \u00e9t\u00e9 invalid\u00e9 par un tribunal pour d\u00e9coupage partisan intentionnel.
