{"id":13048,"date":"2017-02-14T23:34:00","date_gmt":"2017-02-14T23:34:00","guid":{"rendered":"https:\/\/www.commoncause.org\/articles\/puzder-confirmation-in-doubt\/"},"modified":"2017-02-14T23:34:00","modified_gmt":"2017-02-14T23:34:00","slug":"puzder-confirmation-in-doubt","status":"publish","type":"article","link":"https:\/\/www.commoncause.org\/de\/articles\/puzder-confirmation-in-doubt\/","title":{"rendered":"Puzder Confirmation In Doubt?"},"template":"","class_list":["post-13048","article","type-article","status-publish","hentry","article_type-blog-post"],"acf":{"details":{"summary":"Andrew Puzder, who has admitted to hiring undocumented immigrants and opposes paid sick leave policies and overtime pay rules -- among other labor law standards and reforms -- is poised to be our next Labor Secretary.","featured_image":null,"article_type":1103,"authors":["{\"site_id\":\"1\",\"post_type\":\"person\",\"post_id\":12807}"],"related_issues":[149,2082],"related_work":false,"location":null},"sidebar":{"helper_enable_sidebar":false,"helper_media_contact":{"heading":"Media Contact","manually_enter_person":false,"person":null,"name":"","role":"","phone":"","email":""},"helper_links_downloads":{"heading":"Links & Downloads","links":null}},"page_layout":[{"acf_fc_layout":"layout_wysiwyg","_acfe_flexible_toggle":null,"component_wysiwyg":{"content":"<div><p><span lang=\"EN-US\">Andrew Puzder, who has admitted to hiring undocumented immigrants and opposes paid sick leave policies and overtime pay rules -- among other labor law standards and reforms -- is poised to be our next Labor Secretary.&nbsp;<\/span>&nbsp;<\/p><\/div><div><p><span lang=\"EN-US\"><br \/><\/span><\/p><p><span lang=\"EN-US\">A fast food industry executive who has spent 17 years as the president and CEO of CKE Restaurants, the parent company of the Hardee&rsquo;s and Carl&rsquo;s Jr. burger chains, Puzder could be in for a rough reception when the Senate Health, Education, Labor, and Pensions (HELP) Committee takes up his nomination on Thursday.&nbsp;<\/span>&nbsp;<\/p><\/div><div><p><span lang=\"EN-US\"><br \/><\/span><\/p><p><span lang=\"EN-US\">Puzder&rsquo;s confirmation hearing has been delayed four times due to his failure to complete financial disclosure forms required of all Cabinet nominees.&nbsp;<\/span>&nbsp;<a href=\"http:\/\/www.foxbusiness.com\/politics\/2017\/02\/07\/puzder-paid-taxes-on-undocumented-employee-after-labor-secretary-nomination.html\" rel=\"noreferrer\" target=\"_blank\"><span lang=\"EN-US\">Puzder has acknowledged<\/span><\/a><span lang=\"EN-US\">&nbsp;employing an undocumented immigrant as a housekeeper for many years. He took five years to pay back taxes on the employee after discovering her status, a delay described as &ldquo;concerning&rdquo; by Sen. Scott.&nbsp;<\/span>&nbsp;<\/p><\/div><div><p><span lang=\"EN-US\"><br \/><\/span><\/p><p><span lang=\"EN-US\">A Labor Secretary who does no<\/span><span lang=\"EN-US\">t uphold labor laws could be bad news for&nbsp;<\/span><span lang=\"EN-US\">working class people. Under&nbsp;<\/span><span lang=\"EN-US\">Puzder's<\/span><span lang=\"EN-US\">&nbsp;leadership,&nbsp;<\/span><a href=\"https:\/\/www.bna.com\/franchise-model-recipe-n57982076930\/\" rel=\"noreferrer\" target=\"_blank\"><span lang=\"EN-US\">CKE Restaurants compiled the fourth worst labor standards record in the fast food industry<\/span><\/a><span lang=\"EN-US\">&nbsp;<\/span><span lang=\"EN-US\">from 2009-16&nbsp;<\/span><span lang=\"EN-US\">(60% of CKE restaurants had at least one Fair Labor Standards Act violation, according to the Department of Labor).<\/span><span lang=\"EN-US\">&nbsp;The chain&nbsp;<\/span><span lang=\"EN-US\">also has been fined $20 million in California alone over wage and hour violations.&nbsp;<\/span><span lang=\"EN-US\">Carl&rsquo;s Jr. and Hardee&rsquo;s employees have come forward repeatedly with stories of mistreatment and sexual harassment that they say management has ignored<\/span><span lang=\"EN-US\">.<\/span>&nbsp;<\/p><\/div><div><p><span lang=\"EN-US\"><br \/><\/span><\/p><p><span lang=\"EN-US\">Puzder<\/span><span lang=\"EN-US\">&nbsp;has been a vocal critic of Fight for $15, movement that fights to raise the minimum&nbsp;<\/span><span lang=\"EN-US\">wage<\/span><span lang=\"EN-US\">&nbsp;to $15 per hour.&nbsp;<\/span><a href=\"https:\/\/www.nytimes.com\/2016\/12\/08\/us\/politics\/andrew-puzder-labor-secretary-trump.html\" rel=\"noreferrer\" target=\"_blank\"><span lang=\"EN-US\">He has opposed<\/span><\/a><span lang=\"EN-US\">&nbsp;a proposed Labor Department rule that would make&nbsp;<\/span><span lang=\"EN-US\">mehr<\/span><span lang=\"EN-US\">&nbsp;workers eligible for overtime pay, been critical of paid sick leave policies, and is a vocal critic&nbsp;<\/span><span lang=\"EN-US\">of the joint employer doctrine of the Obama administration, which increases liability for a parent company for labor law violations by franchisees or contractors.&nbsp;<\/span>&nbsp;<\/p><\/div><div><p><span lang=\"EN-US\"><br \/><\/span><\/p><p><span lang=\"EN-US\">M<\/span><span lang=\"EN-US\">ike many of President Trump&rsquo;s cabinet nominee&rsquo;s,&nbsp;<\/span><span lang=\"EN-US\">Puzder<\/span><span lang=\"EN-US\">&nbsp;<\/span><span lang=\"EN-US\">also has conflict of interest issues; he's promised to resolve those if confirmed. According to an ethics&nbsp;<\/span><span lang=\"EN-US\">agreement&nbsp; he<\/span><span lang=\"EN-US\">&nbsp;abgelegt&nbsp;<\/span><span lang=\"EN-US\">February 7, Puzder promises to resign as CEO of CKE Restaurants and sever all ties with his&nbsp;<\/span><span lang=\"EN-US\">former employer by selling off his holdings within 90 days of his confirmation; he's also agreed to recuse himself from decisions in which he has a financial interest and has announced that if confirmed he is willing to forgo a $1-5 million bonus he is due to receive from CKE .&nbsp;<\/span>&nbsp;<\/p><\/div><div><p><span lang=\"EN-US\"><br \/><\/span><\/p><p><span lang=\"EN-US\">Although Puzder has taken important steps to assure that he will not have financial conflicts of interest as Labor Secretary, his failure to respect the law and the rights of working class people is extremely troubling.
