Proponents of a legislative proposal that would exempt from public disclosure all research, data and reports produced by public colleges and universities have adopted a strategy of attacking the messenger rather than the message \u2014 that is, the individual who represents the pro-government transparency group, the Connecticut Council on Freedom of Information.<\/span><\/p>\r\n

It\u2019s a diversionary tactic. In actuality, the proponents are attacking the more than 3 million Connecticut residents whose access to all information, with the exception of financial documents, would be completely cut off. Connecticut residents have paid for billions of dollars of bricks-and-mortar improvements at the University of Connecticut, the state\u2019s flagship institution of higher learning, as well as infrastructure upgrades at all of the campuses of the Connecticut State Colleges and Universities system.<\/span><\/p>\r\n

State residents pay the salaries of the faculty, staff and coaches in public higher education in addition to much of the research being conducted by many of these same faculty members, staff and students.<\/span><\/p>\r\n

At its core, this issue is about the public\u2019s right to know what is going on behind the walls of academe. The bill under consideration by the legislature would make those walls impenetrable. It would eliminate accountability and allow misconduct to go undisclosed and possibly unpunished.<\/span><\/p>\r\n

Advocates of this bill, known as SB 394, would have you believe that this proposal was birthed because scores of professors have been harassed and\/or intimidated. To that point, very little evidence was presented at public hearings last year and again this year to suggest that harassment is a huge problem.<\/span><\/p>\r\n

It was acknowledged at this year\u2019s hearing that faculty members who felt they were harassed failed to use provisions in the Freedom of Information Act that would protect them from perpetrators. If the professors had made the effort \u2014 instead of seeking a sweeping exemption from the FOIA \u2014 they could have obtained relief using the law\u2019s \u201cvexatious complaint\u201d provision.<\/span><\/p>\r\n

Harassment is real and can be frightening. But with the proliferation of social media and the coarsening of public discourse, harassment goes on every minute of every day and is aimed at people in every walk of life, from poll workers to librarians to journalists to your friends and family members. Why should professors be a privileged class?<\/span><\/p>\r\n

SB 394 is so far-reaching that it would make off-limits anything that arises from teaching or research. That covers the universe of public higher education, including such innocuous items as course syllabi and book lists.<\/span><\/p>\r\n

Here are some examples of stories that might never have come to light if SB 394 had been in effect:<\/span><\/p>\r\n

* An\u00a084-year-old professor at the UConn School of Medicine collected paychecks for months<\/b><\/a>\u00a0even though he never showed up for work. It turned out he was dead and his wife had been cashing his paychecks.<\/span><\/p>\r\n

* The\u00a0head of the UConn police sex crimes unit<\/b><\/a>\u00a0was removed last year for allegedly kissing and touching staff members.<\/span><\/p>\r\n

* Monkeys died as the result of flawed UConn research projects, culminating in the\u00a0closing of the primate lab<\/b><\/a>.<\/span><\/p>\r\n

* The\u00a0chancellor of the CSCU system<\/b><\/a>\u00a0named cronies to highly-paid administrative jobs without appropriate personnel searches while deep cuts were made to student programs and services.<\/span><\/p>\r\n

* Former\u00a0men\u2019s basketball coach Kevin Ollie sued UConn<\/b><\/a>\u00a0for breach of contract and ultimately reached a multimillion-dollar settlement.<\/span><\/p>\r\n

*\u00a0Allegations of sexual assault\u00a0<\/b><\/a>were made by students at Central Connecticut State University against faculty members resulting in the subsequent finding of sexual misconduct by two professors.<\/span><\/p>\r\n

* The\u00a0faculty Senate voted \u201cno confidence\u201d<\/b><\/a>\u00a0in the president of Western Connecticut State University.<\/span><\/p>\r\n

*\u00a0UConn\u2019s Environmental Research Institute was investigated<\/b><\/a>\u00a0by federal and state authorities and was found guilty of scientific misconduct, resulting in hefty fines and firings.<\/span><\/p>\r\n

There are so many examples that it is impossible to list them here. What state residents should know is that if SB 394 were to be enacted into law, their right to know what goes on at Connecticut\u2019s publicly supported colleges and universities will be extinguished.<\/span><\/p>\r\n
