Phoenix, AZ <\/strong>\u2014 <\/span>Common Cause and\u00a0t<\/span>hree\u00a0Arizona\u00a0voters<\/span>\u00a0joined the ACLU National Voting Rights Project\u00a0and\u00a0the\u00a0ACLU\u00a0of\u00a0Arizona\u00a0in filing a motion to intervene in\u00a0<\/span>United States v.\u00a0Fontes.\u00a0<\/span>The interveners\u00a0<\/span>seek\u00a0to\u00a0prevent the\u00a0U.S.\u00a0Department of Justice (DOJ) from obtaining\u00a0Arizona\u00a0voters\u2019 personal data from the nonpublic voter file.<\/span>\u00a0<\/span><\/p>\r\n

<\/p>\r\n\r\n<\/div>\r\n

\r\n

In\u00a0<\/span>July 2025<\/span>, the DOJ asked Arizona to turn over voters\u2019 full names, dates of birth, addresses, driver\u2019s license numbers, and partial Social Security numbers. The state did not turn over the highly sensitive data, citing state and federal privacy laws. The DOJ filed a lawsuit against Arizona Secretary of State Adrian Fontes in January in an attempt to obtain this same information.<\/span>\u00a0<\/span><\/p>\r\n

<\/p>\r\n\r\n<\/div>\r\n

\r\n

The advocates and voters argue the DOJ\u2019s request threatens voter privacy and could enable voter disenfranchisement. They are represented by attorneys from the American Civil Liberties Union Foundation and the ACLU Foundation of Arizona.<\/span>\u00a0<\/span><\/p>\r\n

<\/p>\r\n\r\n<\/div>\r\n

\r\n

Voters joining the case include\u00a0<\/span>a graduate student, a naturalized citizen, and a formerly incarcerated individual who has had their voting rights restored.\u00a0All individuals have an interest in this case because their backgrounds place them at heightened risk of DOJ targeting, a threat that extends to countless other Arizona voters.\u00a0<\/span>\u00a0<\/span><\/p>\r\n

<\/p>\r\n\r\n<\/div>\r\n

\r\n

\u201cUnelected Washington bureaucrats obsessed with spreading election conspiracies have no right to your private data,\u201d\u00a0<\/span>said Jenny Guzman, Common Cause\u2019s\u00a0Arizona Program\u00a0Director.<\/span><\/strong>\u00a0\u201cThis directive recklessly puts voters\u2019\u00a0private data\u00a0at risk so the Trump administration can score cheap political points. Common\u00a0Cause\u00a0will\u00a0keep fighting to protect voters\u2019 data privacy.\u201d<\/span>\u00a0<\/span><\/p>\r\n

\u201cArizona voters should not be forced to surrender their privacy to satisfy a federal demand that solves no real problem,\u201d\u00a0<\/strong><\/span>said\u00a0Lili\u00a0Nimlo, voting\u00a0rights\u00a0attorney\u00a0at the ACLU of Arizona<\/span><\/strong>.\u00a0<\/strong>\u201cElection\u00a0systems\u00a0in Arizona\u00a0are secure, transparent, and fully compliant with federal law. The DOJ\u2019s\u00a0push\u00a0for full access to\u00a0voter rolls\u00a0is\u00a0both unnecessary and harmful to public trust in our democracy.\u00a0We will not back down\u00a0in our commitment\u00a0to protecting voters\u2019 rights.\u201d<\/span>\u00a0<\/span><\/p>\r\n

\u201cVoters in\u00a0Arizona,\u00a0and all voters, rightly expect the government to keep<\/span>\u00a0<\/span>their personal information secure and only use it for its intended purpose of maintaining accurate records,\u201d\u00a0<\/span>said Maryam Jazini\u00a0Dorcheh, Senior Director of Litigation at Common Cause<\/span><\/strong>.<\/strong> \u201cWe are committed to defending voters\u2019 rights and privacy in\u00a0Arizona\u00a0and nationwide, and this case is one of\u00a014\u00a0where we are stepping in to ensure those protections are upheld.\u201d<\/span>\u00a0<\/span><\/p>\r\n

\u201cThe DOJ\u2019s demand for highly sensitive, personal information from every voter in Arizona is a barely disguised attempt to intimidate eligible voters,\u201d said\u00a0<\/strong><\/span>Jonathan Topaz, staff attorney with the ACLU\u2019s Voting Rights Project.<\/span><\/strong>\u00a0\u201cIt is also illegal. Voters should not have to surrender their privacy to participate in our democracy.\"<\/span>\u00a0<\/span><\/p>\r\n

Common Cause previously\u00a0<\/span>filed a lawsuit in Nebraska<\/span><\/a> to protect state voter data and has joined with the ACLU Voting Rights Project to file motions to intervene as defendants in DOJ lawsuits against Hawai'i<\/span><\/a>,\u00a0<\/span><\/span>Colorado<\/span><\/a>,\u00a0<\/span>Georgia<\/span>,Illinois<\/span>,\u00a0<\/span><\/span><\/a>Maryland<\/span><\/a>,\u00a0<\/span>Massachusetts<\/span><\/a>,\u00a0<\/span>Minnesota,<\/span><\/a>\u00a0<\/span>New Mexico<\/span><\/a>,\u00a0<\/span>Pennsylvania,<\/span><\/a>\u00a0<\/span>Rhode Island<\/span>,<\/span><\/span><\/a>\u00a0<\/span>Washington DC<\/span>,<\/span><\/span><\/a>\u00a0and\u00a0<\/span>Wisconsin<\/span><\/a>\u00a0to\u00a0protect sensitive data in those states.<\/span>\u00a0<\/span><\/p>\r\n\r\n<\/div>\r\n
