The\u00a0EO specifically calls on the FCC to adopt rules\u00a0that would limit the liability shield social media platforms have\u00a0for their content moderation decisions\u00a0under\u00a0Section 230 of the Communications Decency Act.\u00a0The EO\u00a0requires the FTC to consider\u00a0taking action\u00a0against social media platforms when their content moderation decisions\u00a0do not align with their public representations.\u00a0The EO also places restrictions on federal agencies\u00a0from\u00a0advertising on social media platforms and directs the Attorney General\u00a0to create a working group in collaboration with state attorneys general that would examine the enforcement of state statutes and create watch lists of users based on their interactions with social media content.<\/p>\r\n<p lang=\"EN-US\" xml:lang=\"EN-US\">The lawsuit\u00a0explains that the EO is\u00a0a retaliatory move\u00a0in\u00a0response to\u00a0Twitter fact-checking\u00a0inaccurate\u00a0tweets from the President\u00a0about the processes for mail-in-voting.\u00a0\u00a0The lawsuit\u00a0argues\u00a0that the EO violates social media platforms\u2019 First Amendment protections to curate\u00a0and\u00a0fact-check\u00a0content and ensure that accurate information, including how to register to vote and cast a ballot on Election Day,\u00a0is not undermined by misinformation.\u00a0In turn, the lawsuit explains that the EO violates Common Cause\u00a0and other plaintiffs\u2019 First Amendment rights to\u00a0receive curated content without government interference.\u00a0The\u00a0lawsuit seeks a judgment declaring the EO is unconstitutional\u00a0under\u00a0the\u00a0First Amendment and an\u00a0injunction\u00a0preventing\u00a0the President and\u00a0federal agencies from implementing the\u00a0EO.<\/p>\r\n<p lang=\"EN-US\" xml:lang=\"EN-US\"><strong>Statement of Michael Copps, Common Cause Special Advisor and Former FCC Commissioner:\u00a0<\/strong><\/p>\r\n<p lang=\"EN-US\" xml:lang=\"EN-US\">\u201cThe Executive Order is a blatant and illegal power grab by the President to pressure social media platforms\u00a0from combatting disinformation, particularly content that would suppress eligible voters from\u00a0participating in the upcoming election.\u00a0\u00a0Access to accurate information about voting procedures is critical to our democracy\u00a0especially at a time when states are expanding access to voting by mail\u00a0to\u00a0ensure voters can still cast their ballot\u00a0in\u00a0the\u00a0midst\u00a0of\u00a0the\u00a0COVID-19 pandemic.\u00a0Social media platforms have First Amendment rights to curate\u00a0and fact-check content, and their users have rights to receive accurate information without\u00a0this kind of\u00a0government interference.<\/p>\r\n<p lang=\"EN-US\" xml:lang=\"EN-US\">\u201cThe President should not be allowed to\u00a0make retaliatory threats and\u00a0use federal resources as tools\u00a0for voter suppression.\u00a0We urge the Court to find this Executive Order unconstitutional in order to prevent the President from turning the government into the speech police and hand-picking speech he does and does not like.\u201d<\/p>\r\n<p lang=\"EN-US\" xml:lang=\"EN-US\">\u0644\u0642\u0631\u0627\u0621\u0629 \u0627\u0644\u0634\u0643\u0648\u0649\u060c <a href=\"https:\/\/www.commoncause.org\/wp-content\/uploads\/2020\/08\/Social-Media-EO-Complaint-as-Filed.pdf\">\u0627\u0646\u0642\u0631 \u0647\u0646\u0627<\/a>.<\/p>"}}]},"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v26.6 (Yoast SEO v27.1.1) -
