Did you hear? Diebold is set to sell its voting machine division to Election Systems & Software – creating a company that would produce nearly three-quarters of our country's voting machine systems.

I strongly urge the Justice Department's Antitrust Division to conduct a thorough and immediate review of the proposed sale of Premier Voting Solutions (a subsidiary of Diebold) to Election Systems & Software (ES&S).

The proposed sale would likely reduce the competitiveness in the market for voting systems and increase the possibility of acts designed to achieve or maintain monopoly power.  The combined voting machine company would produce and sell as much as 70 percent of the nation's voting systems.  One company dominating the voting machine market means it will be more difficult for election officials to negotiate for voting systems on a limited budget, and raises concerns about reliability and election fraud issues.

ES&S has also been criticized by election officials and experts for anti-competitive behavior, such as dramatically increasing prices for aftermarket service and equipment and misrepresenting the capabilities or certification status of their systems.

The Justice Department must review whether this creation of such a highly concentrated market for voting systems would violate antitrust laws – as well as the public interest and trust in elections.
