Two days after signing House Bill 477 to weaken Utah’s open records law, Governor Herbert signed Senate Bill 165 that makes it harder for citizens to repeal HB 477. This measure bans electronic signature gathering on petitions to qualify referendums on laws passed by the legislature, on citizen initiatives such as recent efforts to enact redistricting reform and tougher ethics rules, and even on candidates who need to qualify for ballot access. Further, the legislature increased the number of signatures required and added unnecessary barriers such as preventing someone from signing the petition that they are authorized to circulate even though the current levels have proven to be too high for legitimate and bipartisan grassroots efforts.
