In June 2014, Common Cause filed an amicus brief with the Delaware League of Women Voters in Delaware Strong Families v. Biden. The case is pending in the United States Court of Appeals for the Third Circuit. The amicus brief defends the constitutionality of Delaware’s campaign finance disclosure law.
Delaware passed its disclosure law in 2012 to close loopholes that allowed corporations and other outside groups to spend money influencing elections without disclosing contributors. The brief argues that Delaware’s law complies with recent Supreme Court decisions that affirmed the constitutionality of disclosure laws because they protect the public’s right to know who is trying to influence elections, and because they curb corruption and its appearance.
